Terms of Use — Homöopathie Ratgeber (Australia)

1. Scope and Contract Formation
These Terms of Use govern the use of the app "Homöopathie Ratgeber" (also published as "Globuli App" and "Globuli Ratgeber", App ID: de.clesk.globuli, hereinafter "App") by Clesk Digital GmbH, Am Biehl 5, 57234 Wilnsdorf, Germany (hereinafter "Provider").
The contract is formed when you download the App and accept the medical disclaimer on first launch. By accepting, you agree to these Terms of Use.
2. Service Description
The App is an informational application about homeopathic remedies (Globuli) and Schuessler salts. It offers:
- A reference guide for homeopathic remedies and Schuessler salts
- A search function by symptoms and remedies
- A glossary of technical terms
- The ability to save remedies as favorites and create personal notes
- AI-based recommendations (Supporters only)
- An OCR scanner for recognizing remedy names (Supporters only)
The App works without registration or login. Key features are available offline.
Medical Notice
The App does not constitute medical advice and does not replace professional medical consultation, diagnosis, or treatment. All information is based on traditional homeopathic indications. The Provider makes no therapeutic claims. Always consult a doctor or pharmacist for health concerns.
3. Supporter Subscription
3.1 Scope
The App offers an optional Supporter subscription with enhanced features (AI-based recommendations, OCR scanner, PDF export). Free core features remain fully usable without a subscription.
3.2 Prices and Processing
The Supporter subscription is available as a monthly subscription (3.99 AUD/month) or annual subscription (29.99 AUD/year). Payment processing is handled exclusively through the Apple App Store or Google Play Store.
3.3 Renewal and Cancellation
The subscription renews automatically unless cancelled at least 24 hours before the end of the current period. Cancellation must be done through the subscription management of the respective store, not through the App or the Provider.
3.4 Right of Withdrawal
Since payment processing is handled by Apple or Google, their respective refund policies apply.
4. Availability
The Provider strives to ensure high availability of the App and online services. There is no guarantee of uninterrupted availability.
5. User Obligations
- The App may only be used for its intended purpose.
- The AI feature must not be misused, particularly not for automated mass queries or circumvention of security mechanisms.
- Using the App for unlawful purposes, manipulating content, or circumventing protective mechanisms is prohibited.
6. Limitation of Liability
The Provider is liable without limitation for damages arising from injury to life, body, or health, and for damages caused by intent or gross negligence. For slight negligence, the Provider is only liable for breach of material contractual obligations (cardinal obligations), limited to foreseeable, typical damages.
The Provider assumes no liability for the accuracy, completeness, or currency of information about homeopathic remedies. AI recommendations are based on traditional indications and do not constitute medical diagnoses. Use is at your own risk.
7. Intellectual Property
All content of the App (texts, database, design, illustrations, code) is protected by copyright and is the property of Clesk Digital GmbH.
8. Changes to Terms of Use
The Provider reserves the right to modify these Terms of Use with effect for the future. Users will be informed of material changes in a timely manner. Modified terms are deemed accepted when the user actively consents.
9. Final Provisions
These terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.
For consumers residing in Australia, nothing in these terms excludes, restricts or modifies any consumer rights under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) which cannot be excluded by agreement.
If any provision of these Terms of Use is or becomes invalid, the validity of the remaining provisions shall not be affected.
